These Terms & Conditions (“Terms”) govern your access to and use of this website and any related pages, forms, advertisements, and services (collectively, the “Site”), operated by LeadSquad (“we,” “us,” or “our”) in connection with the One Day Bath USA campaign. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Acceptance of Terms
By accessing, browsing, or submitting information through the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. We may update these Terms from time to time, and your continued use of the Site means you accept the updated Terms.
2. Eligibility
The Site is intended for users who are at least 18 years of age and located in the United States. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is accurate and belongs to you.
3. Nature of the Service
The Site is a marketing and lead-generation service. We help connect you with home-service professionals, contractors, dealers, estimate providers, and other third parties (“Service Providers”). We are not a contractor, installer, or home-improvement company, and we do not perform the services that Service Providers may offer.
We do not guarantee that any Service Provider will contact you, provide an estimate, perform work, or meet your expectations. Any agreement, transaction, pricing, warranty, or work is solely between you and the Service Provider. We are not a party to and are not responsible for those dealings.
4. Consent to Be Contacted
By submitting your information through the Site, you agree that LeadSquad and/or its partners and Service Providers may contact you about your request and related offers, including by phone call, text message (SMS), email, automatic telephone dialing systems, prerecorded or artificial voice messages, and other means, at the phone number and email address you provide, even if that number is on a state or federal Do-Not-Call list.
Consent is not a condition of purchasing any goods or services. Message and data rates may apply. You may opt out of text messages by replying STOP, opt out of emails using the unsubscribe link, and request to stop marketing calls as described in our Privacy Policy.
5. No Professional Advice
Content on the Site is provided for general informational purposes only and is not professional, legal, financial, or construction advice. You should independently verify any information before relying on it.
6. Intellectual Property
All content on the Site, including text, graphics, logos, images, and design, is owned by or licensed to LeadSquad and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our prior written permission.
7. Third-Party Services and Links
The Site may contain links to or embed third-party websites, tools, advertisements, or services. We do not control and are not responsible for the content, products, practices, or policies of third parties. Your use of third-party services is at your own risk and may be subject to their own terms.
8. Acceptable Use
You agree not to use the Site to submit false, misleading, or unauthorized information; to violate any law; to interfere with the operation or security of the Site; or to use automated means to access or collect data from the Site without our permission.
9. Disclaimer of Warranties
The Site and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, LeadSquad and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or any interaction with a Service Provider, even if advised of the possibility of such damages. Our total liability for any claim will not exceed one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless LeadSquad and its affiliates and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your dealings with any Service Provider.
12. Dispute Resolution and Arbitration
Please read this section carefully. To the extent permitted by law, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court. You and LeadSquad waive the right to a jury trial and the right to participate in a class action. You may opt out of this arbitration provision by contacting us within 30 days of first accepting these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the arbitration provision above, the exclusive venue for any dispute will be the state or federal courts located in Florida.
14. Changes and Severability
We may modify, suspend, or discontinue the Site or these Terms at any time. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
